TIMELINE OF THE EVENTS
March 16th, 2018, The FBI receive a tip about a threat from someone pretending to be me against local school on a website called Hate and Flame. (The tip was actually sent to the FBI just a few minutes after the post was made)
March 17th, 2018, After the police received the tip from the FBI arrest me for making a threat against a school and public official as we as terrorism.
March 18th, 2018, the FBI and Police received tips that more post were being made on the board by me which is impossible because I was sitting in a jail cell with no Internet access. The State Attorney also received tips as well on that day.
March 19th, 2018, the police got a warrant to CTI (my Internet service provider for any and all electronic data and records
March 21st, 2018, the police got a warrant to search and seize “any and all computers” and “any and all information in those computers”
March 29th, 2018, the got a warrant for NFSN (Nearly Free Speech Network) the ISP for the Hate and Flame Website. The records showed I was never on that site.
April 4th, 2018, the police ask the FBI if they could search the computers.
April 11th, 2018, The FBI comes to Taylorville and picks the computers up from the police department.
April 16th, 2018, The Charges against me are dismissed and the warrant is quashed. At the same time the FBI agent O’Sullivan begins to do an inventory of the devices.
April 23, 2018, The FBI begins searching the device and discovers what he claims is a computer-generated image of a young child with an adult male penis in his mouth. The FBI stops the search to get a new warrant for suspected child porn.
March 2nd, 2020, After a 686 day (1 year 10 months 15 days) the FBI gets their second warrant to search Daugherty computer and finds more images.
July 22, 2022, The Assistant US Attorney declined to prosecute Daugherty, and the FBI sends it back to the State hoping they could prosecute Daugherty
September 14th, 2022, I am arrested for Child Porn the bond is set at 250,000 Dollars.
September 15th, 2022, Bond hearing is set, and bond is reduced to 125,000 dollars with conditions NO SOCIAL MEDIA; NO UNSUPERVISED CONTACT WITH MINORS.
NO UNSUPERVISED INTERNET USE
October 13th, 2022, Officer Dorwart of the Illinois State police testify in probable cause hearing.
November 22, 2022, Discovery is given to me to look over
June 26, 2023, We get an expert in constitutional law regarding concern over warrant (1. That it was general warrant and 2. It had been quashed)
September 21, 2023, Lawyer seeks federal file after notified that some files were missing from discovery.
October 5th, 2023, the state attorney indicated that they “have all the files” and “everything has been disclosed”
Somewhere between October 2023 and September 2024 the missing files that were asked for on September 21st, 2023, were handed over.
September 9th motion to suppress is filed.
