There has been no update on the AI CSAM case, that is currently going through the 7th circuit. The case United States v. Steven Anderegg is currently in the 7th circuit appeal court (The 7th circuit covers Wisconsin, Indiana and Illinois) 

United States v. Steven Anderegg (Current 2025/2026 Case)

  • What it is: A landmark federal case addressing whether the First Amendment protects the private possession of AI-generated CSAM.

  • The Ruling: In February 2025, a Wisconsin federal district court ruled that the government cannot ban the private possession of "virtual" obscene material, dismissing a possession charge against Anderegg based on First Amendment privacy rights. However, the court did not extend this protection to the production or distribution of AI-CSAM, so other charges remain.

  • Current Status: The case is actively being appealed by the government in the U.S. Court of Appeals for the Seventh Circuit.
