Ok a recap for the newbies
#51
These people who are posting on this site are posting about material that is irrelevant to this case.  The information that is within the Motion to Dismiss are based on facts found in Discovery and found in the portions of Discovery that were being withheld (A Brady violation) ANYTHING outside of that is irrelevant.

The Facts are simple:

1. The FBI got a tip from an anonymous informant and neither the FBI nor the police corroborated the anonymous informant claim.
2. The police officer wrote a general warrant which was signed by a judge. Just because a warrant is signed by a judge doesn't clear it from being a general warrant. The warrant didn't state what the crime was or the probable cause, nor did it state what they were searching for with particularity or what they were seizing with particularity in those 15 devices.
3. without the stating what the crime was or the probable cause and not stating what the particularity were, the police were allowed to rummage through all 15 devices and seize anything they found, they believed was contraband.
