For the police to not get qualified immunity it must be shown that: 1. they violated a constitutional or statutory right and 2. that constitutional or statutory right has been well established by the courts. General warrants are unconstitutional and violate the fourth amendment and it has been well established by the US Supreme Court since 1927 that General warrants are unconstitutional
