The affidavit submitted by Officer Christian Nelson contains multiple false statements and material omissions. It attributes a threat to Mr. Daugherty without forensic evidence, relies on unverifiable usernames, misrepresents prior legal history, and fails to disclose that the image used was previously submitted by a third party. The affidavit also omits critical facts, such as the use of TOR to anonymize the post and the website’s lack of login requirements. These deficiencies constitute a reckless disregard for truth under Franks v. Delaware, and the warrant and anything found under the warrant should be suppressed.
