Understanding a Motion to Compel

A motion to compel is a formal request to a court asking it to order a party to provide information, documents, or testimony that they have failed to give during the discovery process in a lawsuit. It is one of the most common tools used in the pre-trial phase to ensure that all parties have access to the relevant facts and evidence needed to present their case fairly.

There is NO lawsuit, there is court case. there is no discovery...a motion to compel does not apply
